Phil joined the Firm as a Member in 2012, after practicing for over 8 years at another Raleigh law firm. Phil focuses his practice on principally on insolvency and bankruptcy matters, where he has represented businesses, banks and individuals in all aspects of bankruptcy and insolvency matters, including the filing of bankruptcy petitions under chapters 7, 11 and 13 of the Bankruptcy Code, obtaining relief from the automatic stay, preference defense litigation and seeking declarations that debts were not dischargeable in bankruptcy, judgment enforcement and foreclosures. In addition, Phil has formerly represented a Chapter 7 bankruptcy panel trustee in a wide array of litigation matters including the prosecution of preference avoidance and fraudulent transfer actions as well as objections to discharge. As member of the North Carolina State Bar, Phil also has broad civil litigation experience including the representation of a convenience store chain in a wrongful termination lawsuit; representation of a bank seeking appointment of a receiver over three apartment complexes and the prosecution of a lawsuit on behalf of CPA firm against former partner for breach of a partnership agreement.
